These Terms of Service ("Terms") govern your use of the moldprosolutions.com website and the mold remediation, water damage restoration, and air quality testing services provided by Mold Pro Solutions ("we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.

1. Services Overview

Mold Pro Solutions provides professional mold inspection, mold testing, mold remediation, water damage restoration, and indoor air quality testing services in Montgomery County, Maryland and surrounding areas.

All services are performed by IICRC-certified technicians in accordance with industry standards and applicable Maryland state regulations.

2. Service Agreements and Estimates

Before beginning any remediation or restoration work, we will provide you with:

• A written estimate detailing the scope of work, timeline, and cost
• A service agreement outlining terms, responsibilities, and payment schedule

Work will not begin until you have reviewed and approved the estimate and service agreement. Emergency water extraction services may begin immediately upon verbal authorization, with written documentation to follow within 24 hours.

3. Pricing and Payment

• All pricing is provided in written estimates before work begins
• Estimates are valid for 7 days from the date of issue
• Payment is due upon completion of services unless otherwise specified in your service agreement
• We accept : credit cards, checks, bank transfers
• For insurance-covered work, we will work directly with your insurance company where applicable. You are responsible for any amounts not covered by your insurance policy (deductibles, non-covered items)

Additional work discovered during a project (e.g., hidden mold behind walls) will be communicated to you with a revised estimate before proceeding.

4. Scheduling and Access

• You agree to provide reasonable access to the property for scheduled inspections and remediation work
• If you need to reschedule, please provide at least 24 hours' notice
• Emergency services (water extraction, flood response) are available 24/7 and dispatched as quickly as possible

5. Warranties and Guarantees

Mold Pro Solutions provides the following guarantees:

• Workmanship warranty: All remediation work is warranted for 2 years from completion date
• Post-remediation verification: Every remediation project includes independent post-remediation air quality testing to verify successful treatment
• Satisfaction guarantee: If post-remediation testing does not meet clearance standards, we will re-treat the affected area at no additional cost

Warranties do not cover mold recurrence caused by new water intrusion events, failure to address recommended repairs, or conditions outside the original scope of work.

6. Limitations of Liability

To the fullest extent permitted by law:

• Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim
• We are not liable for pre-existing conditions, undisclosed property defects, or damage caused by events outside our control (natural disasters, subsequent water intrusion, acts of third parties)
• We are not liable for indirect, incidental, or consequential damages including lost profits, property value changes, or relocation costs

7. Your Responsibilities

As a client, you agree to:

• Provide accurate information about your property and the issues you're experiencing
• Disclose known hazards (asbestos, lead paint, structural concerns) before work begins
• Follow all post-remediation recommendations provided by our team
• Address the source of moisture/water intrusion as recommended to prevent recurrence
• Make timely payments in accordance with your service agreement

8. Intellectual Property

All content on moldprosolutions.com — including text, images, graphics, logos, and code — is the property of Mold Pro Solutions or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Website Use

When using our website, you agree not to:

• Submit false or misleading information through any form
• Attempt to access restricted areas of the website or our systems
• Use automated tools to scrape, crawl, or extract data from the website
• Upload malicious code, spam, or harmful content

We reserve the right to restrict or terminate access to the website for any user who violates these Terms.

10. Dispute Resolution

Any dispute arising from these Terms or our services shall be:

• First addressed through good-faith negotiation between the parties
• If unresolved, submitted to mediation in Montgomery County, Maryland
• If mediation fails, resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Montgomery County, Maryland

You agree to indemnify and hold harmless Mold Pro Solutions, its owners, employees, and agents from any claims, losses, or damages (including reasonable attorney's fees) arising from your breach of these Terms or misuse of our services.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
